A severance proposal is more than the headline number

Understand the connected terms around a severance proposal in Germany, including release, bonus, leave, references, and claims.

Calculator and financial papers prepared for a discussion

A severance offer tends to pull attention toward one number. Yet the practical value of an exit package depends on several clauses that operate together.

End date and paid release

An earlier or later end date affects salary, transition time, and the start of a new role. Freistellung wording should be read carefully: is the release revocable, how are holiday and time credits treated, and what happens if you find another job?

Variable compensation

Bonus, commission, equity, and long-term incentives may follow separate plan rules. Ask how the proposed end date and release period affect eligibility, calculation, and payment timing.

Reference and internal communication

An Arbeitszeugnis, agreed wording, job title, and the way departure is announced can matter independently from cash. Specificity is usually more useful than a vague promise to provide a “good” reference.

Waiver language

Settlement drafts often aim to resolve broad categories of claims. Before accepting a payment in exchange for finality, identify exactly which known and unknown claims may be covered. Legal interpretation belongs with qualified counsel.

Benefits and tax

Severance and an Aufhebungsvertrag can carry tax and unemployment-benefit consequences. A preparation consultant can identify the question, but a Steuerberater, Rechtsanwalt, or the Agentur für Arbeit should answer it for your circumstances.

Prepare the package as a set of connected terms, rank your priorities, and keep legal and tax review visible before signature.
